It is understood the family of Clare Nowland has settled the civil case they launched against NSW in the wake of the 95-year-old’s death, bringing this matter to a close.
Senior Constable Kristian James White allegedly tasered the great-grandmother at Cooma’s Yallambee Lodge on 17 May 2023. She reportedly fell and fractured her skull, dying a week later.
A civil matter was filed by her family, stating they were suing the state of NSW.
It has previously been reported that an amended statement was brought by her son, Michael Nowland, seeking various relief on behalf of her estate.
However, NSW District Court records show the civil matter was listed as “discontinued/withdrawn” on 26 February, and the next hearing date that had been set for it was vacated.
A court spokesperson said the matter was closed. No other details were available through the courts.
However, Region understands the matter has been settled on confidential terms.
The lawyer representing the family has been contacted for comment.
Meanwhile, 33-year-old Mr White has been charged with manslaughter over the allegations against him and has been committed to the Supreme Court for trial. He intends to plead not guilty.
This matter is next scheduled to be heard in court on 5 April.
